§ 1 Universal
Your contract partner for all orders within the scope of this website is the Online Trading - Richter, represented by the manager Carsten Richter, Elsa-Brändström-Str. 33c, 53225 Bonn, in the following„ARENASTICKS.de“.
§ 2 Conclusion of the contract
By sending off the order form on the Internet or the telephone order the customer gives off a binding offer. In case of the acceptance of this offer ARENASTICKS.de dispatches a confirmation of order and calculation by e-mail to the customer.
§ 3 Colours
Because every screen returns the colours and tones a little bit differently, a colour divergence of the ready product is possible.
§ 4 Delivery/ Dispatch
(1) The delivery occurs takes place within Germany and world wide.
(2) The goods will be delivered by one logistics enterprise to be chosen by ARENASTICKS.de. The postage-all-inclusive is taken over from ARENASTICKS.de for deliveries to germany. For our abroad costumers, please ask for the freight charge to your country.
(3) The delivery times for individualised, customised products lies naturally between four and six weeks.
(4) Should the delivery not be possible exceptionally within the mentioned term since contract end, ARENASTICKS.de informs the customer at the latest at the deadline immediately in text form (§126b Civil Code) about that.
(5) A claim of the customer on damage substitute because of delay of the achievement (§280 paragraph 2, 286 Civil Code) is excluded, as far as ARENASTICKS.de is a burden with regard to the delay neither intention nor rough carelessness.
§ 5 Prices
For customers from Germany the declared prices are final prices. For abroad costumers please ask us for freight and costums charges.
§ 6 Payment
(1) The payment occurs, untill differently agrees, by precash.
(2) The purchase price is due immediately, without deduction. On payment on calculation count the agreed payment purposes.
(3) With default of the customer ARENASTICKS.de may renounce his demands to a debt collecting agency and transfer the personal data necessary for the payment winding up to this third party.
§ 7 Guarantee
(1) Information, pictures, technical data and dimension descriptions which are included in flyer, catalogues, announcements of price-lists or the website has purely informational character. ARENASTICKS.de takes over no guarantee for the correctness of this information.
(2) As far as a guarantee-liable for payment defect is, the customer is entitled within the scope of the legal regulations to require subsequent performance, to withdraw from the contract or to diminish the purchase price.
(3) In case of returns on the basis of quality faults ARENASTICKS.de will take over the postage costs. The customer is obliged to choose a dispatch method which avoids unnecessary costs. Either the forwarding expenses are to be laid out at first by the costumer, or ARENASTICKS.de transfers the postage costs to the costumer.
(4) The claims of the customer from the guarantee assume that this, provided that it concerns with the customer a merchant, his after §377 HGB to owed investigation and rebuke obligations has followed.
(5) The period of limitation of guarantee claims for the delivered product amounts two years from the receipt of the product. If the customer is an enterpriser, the period of limitation amounts a year.
§ 8 Restriction of liability
(1) ARENASTICKS.de guarantees for others than by injury of life, body and health originating damages(harms) merely, as far as these are based on intentional or roughly careless action or on culpable injury of an essential contract duty by ARENASTICKS.de or their fulfilment assistants. A liability going out it on damage substitute is excluded.
(2) ARENASTICKS.de does not guarantee for the constant and uninterrupted availability of the on-line offer.
§ 9 Cancellation right
(1) If the customer is a consumer, he has the possibility to revoke the contract with ARENASTICKS.de within 14 days on receipt of the product without information of reasons. This cancellation has to to take place in writing, in text form or by return of the product to ARENASTICKS.de.
(2) This cancellation right does not exist with contracts for the delivery of goods, that ARENASTICKS.de produced on the basis of specifications and wishes of the customer has made. This counts in particular to products which are printed with the designs (logo or slogans) of the customer.
(3) With the effective exercise of the cancellation the customer is obliged to the return of the product. This return takes place on danger and costs of ARENASTICKS.de. The customer is obliged to choose a dispatch method which avoids unnecessary costs. Either the forwarding expenses are to be laid out at first by the costumer, or ARENASTICKS.de transfers the postage costs to the costumer.
(4) If an order falls short of a gross price of 40 EUR the customer has to carry the costs of the return.
(5) In case of the cancellation of the contract the customer is obliged to perform resulted deterioration to value substitute with one by the designated putting into use of the thing. The customer has the possibility to avoid this if he checks the thing merely for their usability and suitability. As far as protrudingly nothing else is regulated, in addition, the customer sticks for every deterioration of the thing.
(6) The right on cancellation of the contract exists regardless of the claims of the customer on guarantee, provided that the product shows mistake.
§ 10 Copyright and indemnification clause
(1) If the customer transmits own design or own text, the customer assures towards ARENASTICKS.de that the design is freely from right third parties. In this case possible originator or name law breakings go to loads of the customer. Likewise the customer assures that he violates no other right third by the individuation of the product.
(2) The customer releases ARENASTICKS.de from all demands and claims which are asserted because of the violation by such right third parties. The customer refunds ARENASTICKS.de all originating costs and other damages.
§ 11 Data protection
ARENASTICKS.de is entitled, to store all data about the customer which are in connection with the business connection electronically for the purpose of the contract realisation in accordance with the regulations of the federal data protection act.
§ 12 Court of jurisdiction
For all disputes from this contract the exclusive legal venue is Bonn. ARENASTICKS.de remains entitled to raise complaint or other judicial procedures in the general legal venue of the customer.
§ 13 Partial ineffectiveness
With ineffectiveness of single passages of the general terms of business of ARENASTICKS.de the other regulations remain furthermore effective. Ineffective regulations are substituted with the legal regulation.
